War crimes are not defined solely by intentions, Lester. You can repeat that all you want, and still be incorrect.
In fact your quote that I have above is partially about results. That plays a huge role in this conflict.
Hamas sending several hundred fighters has no chance to kill all Israelis. To claim that Hamas' intention is to kill all Israeli's without the means for Hamas to accomplish this and say their goal is "genocidal" is - to my mind - intellectually insulting.
Israel on the other hand is - from the start and continuing to this day - dropping 2000 lb. bombs on Gaza. There is NO way to make pinpoint strikes in a densely populated area. That is by definition "clearly excessive in relation to the concrete and direct overall military advantage anticipated." That is why there has been a 70-90% civilian kill rate in Gaza.
Hamas - again - changed its charter in 2017. Using the charter from 1988 is disingenuous at best.
Making phone calls to tell someone you are going to kill everyone in their building is still genocide. Particularly when the target is a civilian building.
George Bush hired lawyers to say that torture was legal. It was still a war crime. Same with Israel having lawyers saying that hitting targets where the overwhelming number of deaths will be civilian is a war crime.
Try to spin it however you want, Lester. This is looking worse and worse for Israel long term the longer this goes on. It is blatant ethnic cleansing at best, genocide in my opinion.
