I have listened to and read international lawyers familiar with the subject: Hamas may have genocidal intentions against Israel, but Hamas is unable to commit genocide against Israel because they do not have the means. They are too few and too poorly armed.

Isreal on the other hand, has both the soldiers and equipment needed to commit genocide against the Gazans. IMO they are committing genocide, but I'm not an an ICJ judge, just some rando on the interwebs.
